Liability Waiver

This Liability Waiver is part of the professional services agreement between SOVA Entertainment / SOVA Kids Events and the Client. By signing the contract or registering for our programs, you acknowledge and accept the terms below.

This Liability Waiver / Release of Claims (“Waiver”) applies to participation in children's, family, holiday, corporate, festival, and entertainment events organized, coordinated, or conducted by SOVA Entertainment / SOVA Kids Events (“the Company”). The full service agreement is governed by the laws of the State of Illinois, USA. This document summarizes the liability release provisions that apply when you sign the Company's contract or confirm participation in a program.

1. Scope of this waiver

This Waiver applies to the Client, parents, legal guardians, and participants (including children) attending any event or program where the Company provides animators, characters, interactive programs, workshops, performances, coordination, or full event organization. It is an integral part of the Company's professional services agreement and must be read together with all contract terms, policies, and safety rules.

2. Assumption of risk

Parents and the Client voluntarily agree to the natural and inherent risks of participation in entertainment and activity programs, including but not limited to:

  • Falls and slips;
  • Bumps and accidental collisions;
  • Minor injuries associated with movement, games, sports, and interactive activities;
  • Contact with props, equipment, and other participants;
  • Physical exertion during warm-ups, dance programs, quests, and themed activities.

You understand that such activities involve a degree of risk even when reasonable safety measures are in place. Participation is voluntary, and you accept these risks on behalf of yourself and the participating child(ren).

3. Release of liability

To the fullest extent permitted by applicable law, parents and the Client agree that SOVA Entertainment / SOVA Kids Events, its employees, contractors, volunteers, and partners shall not be liable for injuries, losses, damages, or claims arising from:

  • The behavior of children or other guests;
  • Actions or omissions of parents, guardians, or other supervising adults;
  • Lack of adequate supervision by parents or designated responsible adults;
  • Incidents that are a natural consequence of participation in the described activities;
  • Circumstances outside the Company's reasonable control when safety rules and program guidelines were followed.

This release does not apply in cases of gross negligence or willful misconduct by the Company.

4. Supervision of children

Animators, performers, and program staff do not perform the duties of a nanny or childcare provider. They conduct the program, facilitate activities, and follow safety protocols within the scope of the booked services. Primary responsibility for the supervision, safety, and conduct of children at all times rests with parents, legal guardians, or other responsible adults designated by the Client.

5. Limitations

Nothing in this Waiver limits liability where such limitation is prohibited by law. The Company reserves the right to suspend or discontinue services in cases of dangerous, aggressive, or unlawful behavior, or when safety is threatened — as provided in the main contract. Medical conditions, allergies, and special needs must be disclosed by the Client in advance; the Company is not responsible for consequences arising from undisclosed information.

6. Agreement and acknowledgment

By signing the Company's contract, checking the waiver acknowledgment during registration, or otherwise confirming participation, you state that you have:

  • Read and understood this Liability Waiver;
  • Discussed relevant risks and rules with the participating child(ren), where applicable;
  • Agreed to all terms on behalf of yourself and the minor participant(s) you represent;
  • Confirmed that the information you provided is accurate.

Acknowledgment fields in the contract:

An electronic signature has the same legal effect as a handwritten signature, as stated in the main agreement.
